Terms & Conditions

These Terms and Conditions form the Affiliate Agreement between ENC Affiliate Network (the "Company", "ENC", "we", "us" or "Affiliate Program") and each person or entity accepted as an affiliate partner ("you", "Partner" or "Affiliate"). Applying to or using the Affiliate Program means that you accept these terms.

1. Definitions

Affiliate Program: The cooperation under which a Partner promotes ENC websites or offers through approved affiliate links in return for commission under the applicable deal.
Account: The approved partner account created after an application has been submitted and accepted.
Affiliate Link: A tracking hyperlink supplied or approved by ENC that connects a Partner website or other approved source to an ENC website or project.
Affiliate Website: A website or media property operated or controlled by the Partner.
Affiliate Wallet: The online balance or payment account where commission and other amounts due to the Partner are recorded.
Company Websites / Project: enc.network and any ENC project, mirror or website made available to the Affiliate Program.
Player: A user who registers through a Partner link. The Partner, its employees, relatives and friends are excluded.
Real Player / New Player: A real user who registers and deposits through the Partner link. A New Player is a Real Player whose first deposit occurs within twelve months of registration.
Non-valid Player: A player who does not complete required qualifying activity, is self-excluded or disabled, is a duplicate, or is connected with incentivized, motivated or fraudulent activity.
Commission / Partner Income: The agreed CPA, CPL, RevShare, Hybrid or other reward payable for qualifying activity.
NGR: Net Gaming Revenue calculated as (Bets - Wins) - ((Bets - Wins) x applicable administration fee) - (Issued Bonuses - Cancelled Bonuses) - (Positive Corrections - Negative Corrections). Unless a deal states otherwise, the administration fee is 40%.
Promo Materials: Written, graphic or other marketing materials supplied or approved by ENC.

2. Account creation

Submitting an application and accepting the checkbox confirms acceptance of these terms. The application is part of the Affiliate Agreement.
You must keep login credentials confidential and notify ENC immediately of suspected unauthorized access.
The Program is for direct participation. Accounts may not be opened for, brokered to or transferred to another person without ENC written approval.
You must be at least 18 years old, or the legal gaming age in your jurisdiction if higher.
Registration information must be accurate and kept up to date.
Only one partner account is allowed unless ENC gives prior written consent.
ENC may terminate immediately for artificial or fraudulent traffic, bonus abuse, unauthorized promotion, spam, unethical advertising or any material breach.
You may terminate by written notice. Where no breach exists, approved final commission is processed within 90 days.
A Partner may not create accounts on ENC projects through its own affiliate link or self-refer. Related accounts may be blocked without recovery or payment.

3. Affiliate websites

You are solely responsible for the operation, security and content of every Affiliate Website. It must be professional and comply with applicable law, including data-protection rules. It must not imitate ENC, suggest that ENC owns or operates it, or contain defamatory, discriminatory, violent, obscene, pornographic or otherwise unlawful content.

4. Affiliate links

Only links supplied or approved by ENC may be used. Hiding the traffic source, masking a tracking link or interfering with attribution is prohibited.

5. Email, SMS and database marketing

Written approval is required before email or SMS marketing, or use of ENC intellectual property. If approved, you must have valid consent for each recipient, honor opt-outs and clearly identify that the communication is from you. Campaigns, websites, databases, ads and linked content must comply with applicable advertising, consumer-protection, telemarketing, anti-spam and data-protection laws, including GDPR, CAN-SPAM, TCPA, TSR and Do Not Call rules where applicable.

You remain responsible for compliance and must indemnify ENC against proven direct claims, losses, costs and reasonable legal fees caused by your breach.

6. Promotional materials and traffic sources

ENC may request complete and accurate information about traffic sources. False or incomplete information is a breach.
Do not use spam, fake bonuses, false claims about winnings, guaranteed-win language, targeting of minors or campaigns encouraging multiple accounts.
ENC may block an account without payment or reinstatement for violations.

7. Commissions and payments

Partner Income depends on activity, project and written deal.
Unless stated otherwise, monthly commissions for the previous month are processed between the 10th and 20th.
Models include default or individual RevShare, CPA, CPL, EPC and Hybrid. Individual terms may require traffic testing or a written agreement. Landing pages must contain original content and a genuine user benefit.
Default RevShare for new Partners: 0-5 FTDs: 25% of NGR; 6-10: 30%; 11-20: 35%; 21 or more: 40%.
CPA is counted only when the qualifying deposit occurs within the deal period, normally 30 days after registration and, in approved cases, 90 or 180 days.
For NNCO deals, negative balance up to EUR 10,000 is reset at month end; only the amount above EUR 10,000 may carry forward if the written deal says so. For NCO deals, the full negative balance carries forward.
Payment methods may include bank transfer in EUR or USD, Coinspaid USDC (ERC/TRC) and manual crypto processing (ERC/TRC), subject to ENC compliance and risk policies. BTC, ERC and TRC conversions use the documented rate on the payment date.
Minimum payout is EUR 50 for non-bank methods and EUR 1,000 for bank transfer. No maximum payout applies unless a written deal says otherwise.
ENC may offer a 5% sub-affiliate reward on referred affiliates profits where those affiliates meet the same compliance and disclosure standards.

High Roller / Big Winner policy

A High Roller Player generates negative monthly NGR of EUR 10,000 or more.
That players negative NGR is ring-fenced and is not offset by positive NGR from other players.
Future positive NGR from the same player first offsets that players accumulated negative balance.
Commission becomes payable for that player only once cumulative NGR is positive.
The balance may be carried for a maximum of three consecutive calendar months from classification; remaining negative balance is then reset.
The policy affects only the relevant player. ENC may reasonably classify a player below the threshold where activity has a disproportionate impact, with notice to the Partner.

8. Prohibited activity and fraudulent traffic

ENC does not pay for Non-valid Players. Systems may identify suspicious behavior without disclosing detection algorithms. Where traffic quality requires investigation, payments may be held for up to 90 days. ENC may ask you to suspend traffic while it investigates; players registered after that notice may be declined and unpaid.

9. Responsibility and disputes

ENC does not guarantee uninterrupted or error-free operation and may suspend services for maintenance. We may correct payment, tracking or statistical errors and charge proven financial costs caused by fraudulent referred activity to the responsible Partner. ENC is not responsible for Partner websites or conduct. In a dispute, ENC will review the information provided and issue a final decision.

10. Intellectual property

ENC trademarks, logos, creatives, layouts and other intellectual property may be used only under ENC instructions and with approval where required. You must not register domains, search terms or advertising identifiers that imitate ENC marks. Do not alter approved creatives or launch a campaign without written approval.

11. Confidential information

During the Agreement you may receive confidential information about ENC, technology, operations, projects or commissions. Use it only to perform the Agreement and do not disclose it without written consent. ENC uses technical and organizational safeguards, limits access to people bound by confidentiality and retains Partner data only as long as needed. These duties continue after termination, including the duty not to issue public statements about the partnership without approval.

12. Responsible gaming

You must support responsible gaming and never target persons under 18 or below the legal gaming age.

13. Illegal activity

Do not target territories where gaming or the relevant promotion is illegal. Comply with all laws applicable to your activity and target audience.

14. Data protection and cookies

You must comply with GDPR and any other data-protection or cookie law applicable to your territory, traffic sources and campaigns.

15. Term and termination

The Agreement starts when ENC approves the application and continues until either party gives written notice.
ENC may terminate for breaches of affiliate-link, traffic, fraud, intellectual-property or confidentiality rules, among others.
On termination, remove ENC banners and creatives, disable affiliate links, return confidential information and stop using ENC intellectual property.
Commissions for new customers generated after termination are not payable.

16. Miscellaneous

Neither party is liable for delay caused by events beyond reasonable control, including labor disputes, natural disasters, terrorism, utility or communications failures. If force majeure lasts more than 30 days, either party may terminate by written notice. An invalid provision does not affect the rest of the Agreement. ENC may amend these terms by publishing an updated version and notifying Partners by email; continued participation constitutes acceptance.

17. Governing law and arbitration

This Agreement is governed by the laws of England and Wales. Any dispute concerning its existence, validity, performance or termination shall be finally resolved by arbitration under the LCIA Rules. The tribunal consists of three arbitrators, the seat is London, United Kingdom, and proceedings are conducted in English.
